MPLIFY EVENTS PRIVACY OR SIMILAR STATEMENTS ON THE MPLIFY EVENTS REGISTRATION SITE, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND THE TERMS OF THIS PRIVACY POLICY AND THAT YOU AGREE TO THE COLLECTION, USE, AND/DISCLOSURE OF DATA DESCRIBED AND UNDER THE TERMS HEREIN.

  1. Introduction to Privacy Policy

    1. Welcome to mplifyevents.com is operated by MPLIFY VIETNAM LIMITED and associated companies (colleated or called "MPLIFY" or "us"). We noticed customers (collectively referred to as "users" or "you", calling separately "Organizers" or "Attendees") using mplifyevents.com to attend or organize events, however, noone wants to share its personal information. MPLIFY VIETNAM LIMITED respects customers privacy and commit to protect customers personal information when customers believe in us to provide personal information since buying tickets at mplifyevents.com. This is the principle of accessing privacy and personal information at mplifyevents.com. 

    2. In providing the Services or access to the Platform (as defined in the Terms of Services) to you, we will collect, use, disclose, store and/or process data, including your personal data. In this Privacy Policy, the Platform also refers to the relevant vendor platform. 

    3. "Personal Data" or "personal data" means data, whether true or not, about an individual who can be identified from that data, or from that data and other information to which an organisation has or is likely to have access. Common examples of personal data could include name, identification number and contact information.

    4. This Privacy Policy exists to inform you about how we collect, use, disclose, store and/or process the data we collect and receive in providing the Services or access to the Platform to you, our users, whether you use our Platform as organizers (“sellers”) or attendees (“customers”). We will only collect, use, disclose, store and/or process your personal data in accordance with this Privacy Policy.

    5. We may update this Privacy Policy from time to time. Any changes we make to this Privacy Policy in the future will be posted on this site. If permitted under local law, your continued use of our Services, access to the Platform or use of the Services, including placing Orders in the Platform (as defined in the Terms of Use), or express consent thereto, will constitute an acknowledgment and acceptance you against any changes made to this Privacy Policy. We agree that it is your responsibility to review regularly to see any updates or changes to this Privacy Policy.

    6. It is important for you to read this Privacy Policy along with any applicable notices we may provide for certain circumstances when we collect, use, disclose and/or process personal data about you, so that you take full note of how and why we use your personal data.

    7. Users will take responsibility for security and keep all activities using the service under their registration names, passwords and email inbox. In addition, members are responsible for promptly notifying mplify Events on illegal use, abuse, confidentiality violations, keeping their registration names and passwords of third parties to take appropriate settlement.

    8. This Privacy Policy applies in conjunction with other notices, contract clauses and applicable consent clauses relating to the collection, storage, use of disclosure and/or processing of your personal data by us, and is not intended to supersede such notices and such clauses unless we expressly state otherwise.

    9. All of these terms apply to all mplify Events users, whether organizers (“sellers”) or attendees (“customers”), unless specifically stated to apply to attendees (“customers”) only or to organizers (“sellers”) only.

  2. Use and Disclosure of Personal Data

    1. The intended use

      1. Order

        1. to process of your order for products (whether sold by us or third party sellers) to process orders you send through the Platform;

        2. to respond to, process, deal with or complete a transaction and/or to fulfil your requests for certain products and services and notify you of service issues and unusual account actions;

        3. to confirm and execute payment transactions (including credit card payments, money transfers, offline payments, remittances, or e-wallet transactions) in connection with payments related to you and/or the Services you use. To verify and execute such payment transactions, payment information, which may include personal information, will be transferred to third parties such as payment service providers;

      2. Supply of Services

        1. to facilitate your use of the Services or access to the Platform; 

        2. to administer your account (if any) with us; 

        3. to display your name, username or profile on the Platform (including reviews you may display); 

        4. to deal with or facilitate customer service, carry out your instructions, deal with or respond to any enquiries given by (or purported to be given by) you or on your behalf;

        5.  to contact you or communicate with you via voice call, text message and/or fax message, email and/or postal mail or otherwise for the purposes of administering and/or managing your relationship with us or your use of our Services, such as but not limited to communicating administrative information to you relating to our Services. You acknowledge and agree that such communication by us could be by way of the mailing of correspondence, documents or notices to you, which could involve disclosure of certain personal data about you to bring about delivery of the same as well as on the external cover of envelopes/mail packages;

        6. for identification and/or verification;

        7.  To allow other users to identify you (via "Find my friends" or any other similar function) as a user of the Service, to enable you to find other users and to connect with them on the Platform, and to support the function of socializing the Services (where applicable); 

        8. To facilitate the integration of third party loyal member programs (including those supported by vendors or brands) with our Platform;

      3.  Marketing and advertising

        1. where you give us your prior consent, for marketing and in this regard, to send you by various modes of communication such as postal mail, email, location-based services or otherwise, marketing and promotional information and materials relating to products and/or services (including, without limitation, products and/or services of third parties whom mplify Events may collaborate or tie up with) that mplify Events (and/or its affiliates or related corporations) may be selling, marketing or promoting, whether such products or services exist now or are created in the future. If you are in Vietnam, In the case of the sending of marketing or promotional information to you by voice call, SMS/MMS or fax to your Vietnamese telephone number, we will not do so unless we have complied with the requirements of Vietnam’s Privacy Laws in relation to use of such latter modes of communication in sending you marketing information or you have expressly consented to the same;

      4.  Legal and operational purposes

        1. to identify your identity in connection with the purpose of fraud detection; 

        2. to compare information, and verify with third parties to ensure that the information is accurate; 

        3. to manage, operate, administer and provide you with as well as to facilitate the provision of our Services, including, without limitation, remembering your preferences;

        4. to enforce our Terms of Service or any applicable end user license agreements;

        5. to protect personal safety and the rights, property or safety of others;

        6. to respond to, process, deal with or complete a transaction and/or to fulfil your requests for certain products and services and notify you of service issues and unusual account actions;

        7. to produce statistics and research for internal and statutory reporting and/or record keeping requirements;

        8. to comply with legal requirements (including where applicable, the display of your name, contact details and company details), including requests from law enforcement, in relation to any legal proceedings, or otherwise that we deem necessary; and 

        9. to respond to legal processes or to comply with or as required by any applicable law, governmental or regulatory requirements of any relevant jurisdiction, including, without limitation, meeting the requirements to make disclosure under the requirements of any law binding on mplify Events or on its related corporations or affiliates;

        10. to carry out due diligence or other screening activities (including, without limitation, background checks) in accordance with legal or regulatory obligations or our risk management procedures that may be required by law or that may have been put in place by us;

        11. to audit our Services or mplify Events' business;

        12. To prevent or investigate any actual or suspected violation of the Terms of Services, Privacy Policy, fraud, illegal activity, omission or misconduct, whether in connection with your use of our Services or other matters arising from your relationship with us; 

        13.  to prevent or investigate any fraud, unlawful activity, omission or misconduct, whether relating to your use of our Services or any other matter arising from your relationship with us, and whether or not there is any suspicion of the aforementioned;

        14. To store, host, back up your personal data; 

        15. To deal with and/or facilitate a business asset transaction or a potential business asset transaction, where such transaction involves mplify Events as a participant or involves only a related corporation or affiliate of mplify Events as a participant or involves mplify Events and/or any one or more of mplify Events' related corporations or affiliates as participant(s), and there may be other third party organisations who are participants in such transaction. A “business asset transaction” refers to the purchase, sale, lease, merger, amalgamation or any other acquisition, disposal or financing of an organisation or a portion of an organisation or of any of the business or assets of an organisation; and/or

        16. To facilitate the download of prohibited and controlled items from our Platform;

        17. To compare information, and verify with third parties to ensure that the information is accurate; 

        18. Where necessary, to avoid a threat to life, health or safety;

        19. Analysis, research, business and development;

        20. To understand the user experience of your Services and Platform;

        21. To improve our existing technology (for example voice recognition technology etc.) through machine learning or other means; 

        22. To improve the layout or content of the Platform pages and customize them for users; 

        23. To identify visitors on the Platform; 

        24. To conduct surveys, including conducting research on the demographics and behavior of our users;

        25. To conduct data analysis, testing and research, monitoring and analysis of usage and activity trends;

        26. to conduct research, analysis and development activities (including, but not limited to, data analytics, surveys, product and service development and/or profiling), to analyse how you use our Services, to improve our Services or products and/or to enhance your customer experience;

        27. to allow for advertising and other audits and surveys to, among other things, validate the size and composition of our target audience, and understand their experience with mplify Events’s Services;

        28. To acquire advanced attributes in relation to you based on personal data you provide (either to us or third parties), to provide you with more targeted and/or relevant information; 

        29. To expand our products and services; and 

        30. To better understand our customers. 

      5.  Others

        1. For any other purpose for which your consent has been obtained (hereinafter “Other Purposes); 

        2. To operate decision-making processes automatically in accordance with any of the purposes stated above.

    2. You acknowledge, consent and agree that mplify Events may access, preserve and disclose your Account information and Content if required to do so by law or pursuant to an order of a court or by any governmental or regulatory authority having jurisdiction over mplify Events or in a good faith belief that such access preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) comply with a request from any governmental or regulatory authority having jurisdiction over mplify Events; (c) enforce the mplify Events Terms of Service or this Privacy Policy; (d) respond to any threatened or actual claims asserted against mplify Events or other claim that any Content violates the rights of third parties; (e) respond to your requests for customer service; or (f) protect the rights, property or personal safety of mplify Events, its users and/or the public.

    3. As the purposes for which we will/may collect, use, disclose or process your personal data depend on the circumstances at hand, such purpose may not appear above. However, we will notify you of such other purpose at the time of obtaining your consent, unless processing of the applicable data without your consent is permitted by the Privacy Laws.

  3. SCOPE OF INFORMATION COLLECTION

    1. Personal Data means any information about an individual, whether recorded in material form or not and whether correct or not, the identity of an individual can be identified from such information (whether directly or indirectly), or from such information and information others to which we have or are likely to have access.

    2. The personal data that mplify Events may collect includes but is not limited to:

      1. name;

      2. email address;

      3. date of birth;

      4. billing address;

      5. bank account and payment information;

      6. telephone number;

      7. gender;

      8. information sent by or associated with the device(s) used to access our Services or Platform;

      9. information about your network and the people and accounts you interact with;

      10. photographs or audio or video recordings;

      11. government issued identification or other information required for our due diligence, know your customer, identity verification, or fraud prevention purposes;

      12. marketing and communications data, such as your preferences in receiving marketing from us and third parties, your communication preferences and history of communications with us, our service providers, and other third parties;

      13. usage and transaction data, including details about your searches, orders, the advertising and content you interact with on the Platform, and other products and services related to you;

      14. location data;

      15. any other information about the User when the User signs up to use our Services or Platform, and when the User uses the Services or Platform, as well as information related to how the User uses our Services or Platform; and

      16. aggregate data on content the User engages with.

    3. You agree not to submit any information to us which is inaccurate or misleading, and you agree to inform us of any inaccuracies or changes to such information. We reserve the right at our sole discretion to require further documentation to verify the information provided by you.

    4. If you sign up to be a user of our Platform using your social media account (“Social Media Account”), link your mplify Events account to your Social Media Account or use any mplify Events social media features, we may access information about you which you have voluntarily provided to your Social Media Account provider in accordance with such provider's policies, and we will manage and use any such personal data in accordance with this Policy at all times.

    5. If you do not want us to collect the aforementioned information/personal data, you may opt out at any time by notifying our Data Protection Officer in writing. Further information on opting out can be found in the section below entitled "How can you withdraw consent, remove, request access to or modify information you have provided to us?"  Note, however, that opting out or withdrawing your consent for us to collect, use or process your personal data may affect your use of the Services and the Platform.  For example, opting out of the collection of location information will cause its location-based features to be disabled.

    6. We may collect, use, disclose and/or process your personal data for one or more of the following purposes:

      1. when you register and/or use our Services or Site, or open an account with us;

      2. when you submit any form, including, but not limited to, application forms or other forms relating to any of our products and services, whether online or by way of a physical form;

      3. when you apply for, register or otherwise use any of the Services;  

      4. when you enter into any agreement or provide other documentation or information in respect of your interactions with us, or when you use our products and services;

      5.  when you interact with us, such as via telephone calls (which may be recorded), letters, fax, face-to-face meetings, social media platforms and emails;

      6. when you record any user-generated content uploaded to the Platform;

      7. when you use our electronic services, or interact with us via our website or use services on our website. This includes, without limitation, through cookies which we may deploy when you interact with our applications or website;

      8. when you carry out transactions through our website or Services;

      9. If you register to be a user on our Platform by using your social media account, we may access personal data about you that you have submitted voluntarily to your social media provider in accordance with the policies of that social media provider and we will handle your personal data in accordance with this Privacy Policy.

      10. when you carry out transactions through our website or Services;

      11. when you provide us with feedback or complaints;

      12. when you register for a contest, for games or game specific events, or

      13. when any other user of the Platform posts any comments about content you upload to the Platform or when you post any comments about other users ’content uploaded to the Platform;

      14.  when you interact with us offline, including when you interact with our external customer service agents.

      15. when a third party makes a complaint against you or content that you have uploaded to the Platform; and

      16. when you visit, use or interact with the Site or our mobile applications, we may collect certain information by automated or passive means using a variety of technologies, which technologies may be downloaded to your device and may set or modify settings on your device. The information we collect may include, without limitation, your Internet Protocol (IP) address, computer/mobile device operating system and browser type, type of mobile device, the characteristics of the mobile device, the unique device identifier (UDID) or mobile equipment identifier (MEID) for your mobile device, the address of a referring web site (if any), and the pages you visit on our website and mobile applications and the times of visit. We may collect, use disclose and/or process this information only for the Purposes (defined below).

      17. mplify Events platform may collect precise information about the location of your mobile device using technologies such as GPS, Wi-Fi, etc.. We collect, use, disclose and/or process this information for one or more Purposes including, without limitation, location-based services that you request or to deliver relevant content to you based on your location or to allow you to share your location to other users as part of the services under our platform. For most mobile devices, you are able to withdraw your permission for us to acquire this information on your location through your device settings. If you have questions about how to disable your mobile device's location services, please contact your mobile device service provider or the device manufacturer. 

      18. The above does not purport to be exhaustive and sets out some common instances of when personal data about you may be collected.

  4. INFORMATION STORAGE TERM

Personal data of members will be stored until there is a cancellation request or a login member and canceled. Left in all cases Member personal information will be confidential on mplifyevents.com server.

  1. People or organizations can be accessed with PERSONAL DATA 

    1. In Vietnam, the legal entity controls the user's personal data as MPLIFY VIETNAM LIMITED;

    2.  We may share (or allow the sharing of) your personal information with and/or transfer your personal information with third parties and/or our affiliates for the purposes stated above. Third parties and affiliates, which may be located within or outside the country, include but are not limited to:

      1.  Our subsidiaries, affiliates and related corporations;

      2. Service providers (such as agents, vendors, contractors and partners) in areas such as payment services, marketing, data analysis, market or customer research, surveys, social media, customer service, installation services, information technology and website hosting; 

      3. Service providers and their related companies; 

      4. Other users of the Platform or Services

      5. contractors, agents, service providers and other third parties we use to support our business. These include but are not limited to those parties which provide administrative or other services to us such as mailing houses, financial services providers, advertising and marketing partners, telecommunication companies, information technology companies, and data centres;

      6. governmental or regulatory authorities having jurisdiction over mplify Events or as otherwise permitted under Section 5.4; 

      7. a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of mplify Events’ assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which personal data held by mplify Events about our Service Users is among the assets transferred; or to a counterparty in a business asset transaction that mplify Events or any of its affiliates or related corporations is involved in; and

      8. third parties to whom disclosure by us is for one or more of the Purposes and such third parties would in turn be collecting and processing your personal data for one or more of the Purposes

    3. We may share user information, including statistical and demographic information, about our Users and information about their use of the Services with advertising partners and third party suppliers of advertisements, remarketing, and/or other programming.

    4. You acknowledge, consent and agree that mplify Events may access, preserve and disclose your Account information and Content if required to do so by law or pursuant to an order of a court or by any governmental or regulatory authority having jurisdiction over mplify Events or in a good faith belief that such access preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) comply with a request from any governmental or regulatory authority having jurisdiction over mplify Events; (c) enforce the mplify Events’ Terms of Service or this Privacy Policy; (d) respond to any threatened or actual claims asserted against mplify Events or other claim that any Content violates the rights of third parties; (e) respond to your requests for customer service; or (f) protect the rights, property or personal safety of mplify Events, its users and/or the public.

    5. In disclosing your personal information to them, we endeavor to ensure that third parties and our affiliates maintain the security of your personal information from access, collection, use, disclosure, unauthorized processing or similar risks and keep your personal information only as long as your personal information is required to achieve the purposes set out above.

    6. Third parties may unlawfully intercept or access personal data transmitted to or contained on the site, technologies may malfunction or not work as anticipated, or someone might access, abuse or misuse information through no fault of ours. We will nevertheless deploy reasonable security arrangements to protect your personal data as required by the Privacy Laws; however, there can inevitably be no guarantee of absolute security such as but not limited to when unauthorised disclosure arises from malicious and sophisticated hacking by malcontents through no fault of ours.

    7. We may also share your personal information in connection with any proposed purchase, merger or acquisition of any part of our business, provided that we meet the requirements of data protection laws applicable when disclosing your personal information.

    8. We may share or permit the transfer of your personal data overseas for any of the purposes set out in this Privacy Policy. However, we will not transfer or allow the transfer of your personal data overseas unless such transfer complies with applicable law.   

    9. We may share your personal data with third party service providers or our affiliates (for example payment service providers) so that they can offer services to you other than those in connection with your use of our Platform or Services. Your acceptance and use of the services of third party service providers or our affiliates is subject to the terms and conditions as may be agreed between you and our third party service providers or affiliates. Upon acceptance of a service offer by a third party service provider or our affiliates, the collection, use, disclosure, storage, the transfer and processing of your data (including personal data and other data we disclose to third party service providers or our affiliates) is subject to the privacy policies of our applicable third party service providers or affiliates, where they are the data controllers of such data . You agree that any inquiries or complaints relating to the receipt or use of services provided by our third party service providers or affiliates should be directed to the parties named in the applicable privacy policy.   

    10. As set forth in mplify Events’ Terms of Service, Users (including any employees, agents, representatives, or any other person acting for such User or on such User’s behalf) in possession of another User’s personal data through the use of the Services (the “Receiving Party”) hereby agree that, they will (i) comply with all applicable Privacy Laws with respect to any such data, including any collection, processing, storage or transfer of such data; (ii) allow mplify Events or the User whose personal data the Receiving Party has collected (the “Disclosing Party”) to remove his or her data so collected from the Receiving Party’s database; and (iii) allow mplify Events or the Disclosing Party to review what information has been collected about them by the Receiving Party, in each case of (ii) and (iii) above, in compliance with and where required by applicable laws.

    11. Notwithstanding anything set forth herein, Sellers (including any employees, agents, representatives, or any other person acting for such User or on such User’s behalf) shall comply with all applicable Privacy Laws and, in respect of any buyer’s personal data received from mplify Events, (i) are not permitted to use such buyer’s personal data except as reasonably necessary to respond to buyers’ enquiries and to carry out respond to, process, deal with or complete a transaction without the buyers’ and mplify Events’ prior written consent; (ii) should refrain from contacting buyers using such information outside of the mplify Events platform; (iii) are not permitted to disclose such buyer’s personal data to any unauthorized third parties without the buyer’s and mplify Events’ prior written consent; (iv) shall employ sufficient security measures to protect each mplify Events user’s personal data in their possession, retain such data only for as long as necessary for the purposes above and in accordance with the Privacy Laws,  and to delete or return such data to mplify Events upon any request from mplify Events or as soon as reasonably possible upon completion of the transaction; and (v) to inform mplify Events at support@mplifyevents.com in the event of any potential data breach or other loss of such user’s data.

  1. Methods and tools for users to access and edit their personal data on the e-commerce system of information collection units

    1. For User’s continuing to use the mplify Events page and let us provide services, the personal data of the user provides us to accurate and complete. Users are responsible for notifying us about the changes to the user's personal data, or in case the user believes that the personal data we collect about the user is not exactly, incomplete, misleading or not updated.

    2. If you have an account with us, you may personally access and/or correct your personal data currently in our possession or control through the Account Settings page on the Site. If you do not have an account with us, you may request to access and/or correct your personal data currently in our possession or control by submitting a written request to us. We will need enough information from you in order to ascertain your identity as well as the nature of your request so as to be able to deal with your request. Hence, please send your written request by emailing our data manager at support@mplifyevents.com.

    3. You may update your personal data at any time by accessing your account on the Platform. Users have the right to provide personal information to us and can change that decision at any time. You have the right to self-check, update, adjust your personal information by logging into your account and editing your personal information or asking us to do this.

    4. You may withdraw your consent for the collection, use and/or disclosure and/or request deletion of your personal data in our possession or under our control by sending an email to our Personal Data Protection Officer at support@mplifyevents.com, and we will process such requests in accordance with this Privacy Policy and our obligations under the Privacy Laws and other applicable law. However, your withdrawal of consent may mean that we will not be able to continue providing the Services to you and we may need to terminate your existing relationship and/or the contract you have with us.

    5. We take steps to share users' personal data updates with third parties and our affiliates if the user's personal data is still needed for purposes specified above.

7.6 Users can request information about the user's personal data that we have collected or asked about how the user's personal data may have been used, disclosed, Store or handle through personal account information settings on mplifyevents.com or by contacting us according to the contact information below. Users can also request to edit any errors or shortcomings in the user's personal data that we have collected in the same way. To support the processing of users' requirements, we may need to ask the user to provide additional information about the user's request. In the case of permission law, we may refuse to make the user's amendment requirements if these requests are difficult to implement or not reasonable.

  1. In the event that the current data protection law allows, we reserve a reasonable administrative fee for accessing the user's personal data records. In this case, we will notify users of the fee before processing the user's request. 

We will/may also be charging you a reasonable fee for the handling and processing of your requests to access your personal data. If we so choose to charge, we will provide you with a written estimate of the fee we will be charging. Please note that we are not required to respond to or deal with your access request unless you have agreed to pay the fee.

  1. COMMITMENT TO CUSTOMERS' PERSONAL INFORMATION SECURITY

    1. Personal information on mplifyevents.com is committed to provide absolute security according to mplify Events’ personal information protection policy. The collection and use of each member's information is only done when there is a consent of that customer except for other legal laws.

    2. To protect your personal data from access, collection, use, disclosure, processing, copying, modification, disposal, loss, misuse, unauthorized modification or similar risks, we have introduced appropriate administrative, physical and technical measures such as

      1.  Restrict access to personal data to individuals who require access;

      2. Maintain technology products to prevent unauthorized computer access; 

      3. Use 128-bit SSL (secure sockets layer) encryption technology when processing your financial details; and/or

      4. Implement other security measures required by applicable law.

    3. You must not transfer, provide or disclosed to any third parties about members' personal information when there is no permission to agree from such members.

    4. However, you should be aware that no method of transmission over the internet or electronic storage method is completely secure. While security cannot be guaranteed, we strive to protect the security of your information and constantly review and improve our information security measures.

    5. In case the hacker information storage server leads to a member's personal data loss, mplifyevents.com will be responsible for announcing the case for the authorities to investigate and promptly handle and announce for known members.

    6. Completely security all member's online transaction information includes digitized voucher accounting invoice information in mplifyevents.com Safety Center data area.
